Terms of Service

1. AGREEMENT TO TERMS

These Terms of Service constitute a legally binding contract between you (“User,” “you”) and TourGo (“we,” “us,” “our”), a platform operated in the Republic of Colombia, that enables property managers and owners to create and manage hotels, bookings, customers, transactions, rooms, and related information via the TourGo platform (the “Service”).

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICE.

2. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Updates will be posted here with a new “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

3. INTELLECTUAL PROPERTY

The Service, including all software, designs, databases, trademarks, and content, is owned by TourGo and protected under Colombian copyright law (Ley 23 de 1982) and international treaties.

You are granted a limited, revocable, non-exclusive, non-transferable license to use the Service solely for lawful property management purposes.

4. USER OBLIGATIONS

By using TourGo, you represent and warrant that:

All information submitted is true, accurate, and complete.
You are at least 18 years old and have full legal capacity under Colombian law.
You will comply with Ley 1581 de 2012 (Habeas Data), anti-discrimination laws, and DIAN tax reporting requirements.
You will not use the Service for illegal purposes, including money laundering (Ley 599 de 2000) or fraud.

5. ACCOUNT REGISTRATION

You must register to access core features. You are solely responsible for maintaining the confidentiality of your login credentials and all activities under your account.

6. PROHIBITED CONDUCT

You agree not to:

Scrape, copy, or extract data from the Service without written consent.
Interfere with platform security or attempt unauthorized access.
Use the Service to harass, defame, or discriminate against others.
Upload viruses, malware, or harmful code.
Store protected health information (PHI) or financial data beyond what is necessary for bookings.
Violate Colombian laws, including the Código Penal or Ley de Delitos Informáticos.

7. USER DATA & LICENSE

You retain ownership of all data you input (“User Data”), including hotel listings, guest records, and transactions. By using TourGo, you grant us a worldwide, royalty-free, non-exclusive license to:

Host, process, display, and back up your User Data to deliver the Service.
Use anonymized, aggregated data for analytics, improvements, and marketing (never re-identifiable).

8. PRIVACY POLICY

Your use of the Service is also governed by our Privacy Policy, incorporated herein by reference.

9. SERVICE AVAILABILITY

We do not guarantee 100% uptime. We may suspend, modify, or terminate the Service at any time without liability.

10. GOVERNING LAW

These Terms shall be governed exclusively by the laws of the Republic of Colombia, without regard to conflict of law principles.

11. DISPUTE RESOLUTION

Any dispute arising from these Terms shall be resolved through binding arbitration in Bogotá, D.C., administered by the Cámara de Comercio de Bogotá (CCB) under its arbitration rules. The arbitration shall be conducted in Spanish or English, at TourGo’s discretion. You waive the right to participate in class actions.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY COLOMBIAN LAW, TOURGO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, DATA, OR BUSINESS OPPORTUNITY.

Our aggregate liability shall not exceed the total fees you paid to TourGo in the 12 months preceding the claim (or COP 10,000,000 if no fees were paid).

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless TourGo, its directors, and employees from any claims, losses, or damages arising from your use of the Service or breach of these Terms.
